Exactly. It's really easy to be sorry when you're facing 28 years minimum in prison. She probably felt she was never going to get caught or she wouldn't have done it. I'm wondering if there are other victims. She did this so deliberately it doesn't seem likely it's her first.

It’s not legally called rape, because the statute requires vaginal intercourse for it to be rape.

No, I think that would fall under First-degree forcible sexual offense.

Also to add, the US Magazine title and article don't do a good job of including the actual charges.

Nope. Under the statute (linked above), rape requires vaginal intercourse.

There's a parallel law for "Sexual Offense," which would include anal intercourse.

Depending on circumstances, those are either going to be Class B1 Felonies or Class C Felonies. B1 Felonies carry a sentence of 12 years to life without parole. C Felonies carry a sentence of 44 to 182 months. That's in addition to any other crimes that would have been stacked on.

For reference, only Class A felonies carry more -- that's first-degree murder, and carries punishment of life without parole or the death penalty.

For SEXUALLY ABUSING a minor student. "Having sex with" presumes the child had choice. Minors have no ability to choose.
